Obeying the “rulers” or the Rulers?

What is to be done regarding the Prophet’s  order to obey the ruler even if he strikes our backs and takes ours wealth?

Did you understand this ayaah by yourself or did you refer to what the Sahaba, the tabieen and the major scholars of this ummah said about this verse?

If you referred to the Sahaba and tabieen, could you mention what they said about this.

Kindly do not resort to avoiding the question like last time.

Narrated Junada bin Abi Umaiya:

We entered upon ‘Ubada bin As-Samit while he was sick. We said, “May Allah make you healthy. Will you tell us a Hadith you heard from the Prophet (ﷺ) and by which Allah may make you benefit?” He said, “The Prophet (ﷺ) called us and we gave him the Pledge of allegiance for Islam, and among the conditions on which he took the Pledge from us, was that we were to listen and obey (the orders) both at the time when we were active and at the time when we were tired, and at our difficult time and at our ease and to be obedient to the ruler and give him his right even if he did not give us our right, and not to fight against him unless we noticed him having open Kufr (disbelief) for which we would have a proof with us from Allah. [sahih Bukhari]

Thus, there is a limit to which the believers are to restrain themselves- that limit is OPEN KUFR for which there is clear proof from Allah.

In the judgment of the Muslims’ regimes today, the “clear proof” is in the constitutions of the regimes which ratify and elevate above all others the bodies of laws adopted by their respective regimes. Thus, the Turkey constitution empowers the regime to adopt Swiss legal code to determine all the judgments of the courts; and in the permanent treaties ratified by the executive branches and legislative branches of the regimes, making them permanent and therefore established laws upon the Muslim lands.

And they openly publish and declare these “clear proofs” and stand ready to defend them with massive militaries that are trained and equipped primary to suppress and defend against their own Muslim peoples.

And in the next primary textual evidence related to this matter:

Auf bin Malik (May Allah be pleased with him) reported:
Messenger of Allah (ﷺ) said, “The best of your rulers are those whom you love and who love you, and those who supplicate Allah in your favour and you supplicate Allah in their favour. The worst of your rulers are those whom you hate and who hate you; and whom you curse and who curse you.” It was asked (by those who were present): “Should not we oppose them?” He said, “No, as long as they establish Salat; as long as they establish Salat in your midst.” [sahih Muslim]

The phrase “establish salat in your midst” has been misused to imply that the regimes can do anything else- ally with kufar enemies of Allah, adopt and impose kufr laws and treaties, bring kafir religions and occultism into Muslim lands ( like the spread of Hindu temples, Christian churches, and Masonic lodges in the Arabian Pennisula under the present regimes)- but as long as they maintain masajid (except the masajid are actually maintained by awqaf) and monies are spent maintaining salat and immat, then all the rest is permissible and Muslims are supposed to restrain themselves.

But this particular text must first be understood in the context of the Sunnah of the Prophet . The Prophet’s  Islamic state had an organizational structure which included two executive assistants who functioned like we know today to be deputies and advisors and who had legal and executive authority to rule and judge in place of the Prophet  but who’s judgments and executive decisions could be overruled by the Prophet . Those two muawin were: Abi Bakr and Umar 
And the Prophet  divided the state into two primary branches: the Salat and the Zakat. So he appointed sahaba  to either collect zakat, or to establish salat.
And in some cases, the sahabi  did both, as in Muadh ibn Jabal  in Yemen.

And the “establishment of salat” branch functioned as not only leading worship, but rendering judgments in cases, and in diplomatic relations- all from the masajid.

And his organizational structure for regions outside of the immediate vicinity of al Madinah included dividing regions into wilaya- governances. And each wilaya was governed by a wali, a governor appointed by the Prophet . And depending on the discretion of the Prophet , that wali “established salat” and collected zakat, or he only “established salat” while another Muslim was appointed to collected zakat.

So a wali in another city would “establish salat” by not only leading prayers, but making the khutbah on jumuah day, and judging in disputes, and meeting with local leaders, and judging on criminal matters and upholding criminal laws, etc.

And this is well known among the Sahaba  as there are many events among them in relation to the establishment of salat during the life of the Prophet .

And during the khulafa rashida, the organizational structure of the Islamic state was altered in varying ways according to the administrative systems adopted, as in khalifa Umar  adopting the Persian administrative systems and so on.

And during the Ummaya era, the khulafa segregated the “establishment of salat” concept into segmented branches, such as the khalifa would no longer consider his meeting place to be the masjid, rather it was his palace. And then judgments would take place inside his palace and diplomacy was maintaind within his palace rather than the masajid, and so forth.

So the concept of “establish salat” as practiced by the Prophet  meant the establishment of Islam, the establishment of criminal law, foreign affairs, judging disputes, etc. And the salaf was salih such as the four imams intrinsically recognized and addressed this and mentioned this in their works.

What has happened today is the continued organizational segmentation and division of the concepts of Islam, such as categorizing Islam a “religion”. And this segmentation has meant Muslims and ulama today to think “establish salat” means only leading prayers, and maintaining masajid, and paying imams.

And so, the matter in question is “how do these textual evidences apply to our reality today”? The Muslims’ regimes have clearly demonstrated CLEAR PROOF of kufr, defiantly so, and they have CLEARLY abandoned “establishment of SALAT” as the Prophet  taught and practiced it.

And this is NOT a KHAWARIJ opinion- rather it is a judgment made by ulama who sought to follow and uphold the Sunnah of the Prophet  and uphold the Sunnah of the Rightly Guided Khulafaa as the Prophet  conclusively required us to do.

Abu Najeeh al-’Irbaad ibn Saariyah (may Allah be pleased with him) who said:
The Messenger of Allah (peace and blessings of Allah be upon him) gave us a sermon by which our hearts were filled with fear and tears came to our eyes. So we said, “O Messenger of Allah! It is as though this is a farewell sermon, so counsel us.” He (peace and blessings of Allah be upon him) said, “I counsel you to have taqwa (fear) of Allah, and to listen and obey [your leader], even if a slave were to become your ameer. Verily he among you who lives long will see great controversy, so you must keep to my Sunnah and to the Sunnah of the Khulafa ar-Rashideen (the rightly guided caliphs), those who guide to the right way. Cling to it stubbornly [literally: with your molar teeth]. Beware of newly invented matters [in the religion], for verily every bidah (innovation) is misguidance.”

And the reality suggests that the Muslims`regimes are the ones who have invented new matters in the deen, such as segmenting the Deen into categories so the Muslims separate religion from life, and politics and law from salat, and the ruling from the Deen. Not to mention their invalid constitutions and man made bodies of law and kufr treatiesby which they judge and rule and impose upon the Muslim people.

And in this way in particular, the Muslims` regimes are the KHAWARIJ, they are the ones opposed to the Sunnah, even insulting the Sunnah of the Prophet , like Dhul Khuwasayri. They are the ones who have learned the Quran and Sunnah, but place it behind their backs in ruling and life, except to manipulate the Muslim people to follow them.
And it is the regimes who are calling for changing the Shariah, for imposing kufr treaties. And they are the ones waging war against Islam while obeying and allying with the mushrikeen. And they are the ones who have the masses of Muslim youth in their hands, teaching them kufr ideologies in schools and through their media and in their national cultures.
