  1. Whom we should fight and kill, and why we should fight and kill them.by Imaam Ibn Taymiyyah rahimahullah.

    Shaykh ul-Islaam Ibn Taymiyyah, delivers a decisive and fatal blow to the hypocrites and false claimants to the blessed salafi da’wah. Those deviants who put obstacles in the path of Jihaad which do not exist, and belittle and negate the obligation of Jihaad in our times.

    Shaykh ul-Islaam Ibn Taymiyyah rahimahullah, said in Majmoo’ il-Fataawa Vol28 348,

    ” Whomsoever the da’wah [invitation] of the Messenger sallallahu alayhi was salama has reached them- and that [da’wah] is to the Deen of Allah, with which he was sent -and they do not respond to [and accept] it, it then becomes an obligation to fight them[1] “..until there is no more Fitnah[shirk], and the Deen[religion] is for Allah alone.” Surah al-Baqarah:193.

    When Allah sent His Prophet and commanded him to invite the creation to His Deen, Allah did not give permission to him to kill anyone or to fight them until after the hijrah[migration] to al-Madeenah. Then he permitted the Prophet and the Believers in Allah The Most High’s saying,

    ” Permission is given to those who are being fought against, as they are oppressed, and indeed Allah is able to give them victory, those who have been driven out of their homes[unjustly] without due right, only due to them saying ‘Allah[alone] is our Lord’. And if Allah did not repel one group of people by way of another, the monasteries, houses of worship and Masaajid, wherein Allah’s name is mentioned abundantly would have been pulled down[destroyed]. Truly Allah will assist those who assist in His cause. Indeed Allah is the All-Powerful, the All-Mighty. Those whom, if we establish them in the land, establish the Salaat, and pay the Zakaat, and enjoin good and forbid evil, and the end of [all] the affairs is with Allah.” Surah al-Hajj:39-41.

    Then after this, Allah obligated upon then fighting with Allah The Most High’s saying,

    ” Fighting is prescribed for you though you dislike it, and it may be that you dislike something which is good for you, and you you may like something which is bad for you, and Allah knows and you do not know.” Surah al-Baqarah:216.

    And in numerous chapters of the Qur’aan which were revealed in Madeenah, the importance of the obligation of Jihaad is greatly stressed upon, and [also] the condemnation of those who abandon it, describing them with Nifaaq[hypocrisy] and [having] a disease in their hearts, as Allah The Most High says,

    ” O you who believe, do not take as Awliyaa'[allies] your fathers or your brothers if they prefer disbelief over belief, and whoever takes them as allies, then they are the Thaalimoon[wrongdoers]. Say, “If your fathers, and your sons, and your brothers, and your wives, and your families, and the wealth you have gathered, and the business in which you fear a decline, and the homes in which you take pleasure are more beloved to you than Allah and His Messenger and Jihaad in His cause, then wait until Allah brings about His decree, and Allah does not guide the rebellious group.” Surah at-Tawbah:23-24.

    And Allah The Most High says,

    ” Verily the believers are those who have believed in Allah and His Messenger, and after they do not doubt, and they perform Jihaad in the path of Allah with their wealth and with their lives, those are the Truthful[believers].” Surah Al-Hujuraat:15

    And Allah The Most High said,

    ” When a Muhkam[categorical, clear] Surah is revealed wherein fighting is mentioned, you will see those with a disease in their hearts looking at you with a look of one who is about to faint from [fear of] death, but it was better for them to [have] obedience and good words. When the matter[of fighting] was decided, if they had been truthful to Allah that would have been better for them. So would you then, if you had turned away[from Jihaad] spread corruption in the land and sever the ties of kinship.” Surah Muhammed:20-22.

    And many other [similar verses] in the Qur’aan”

    In the Two Saheeh collections the Messenger sallallahu alayhi was salama said,

    ” أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلهَ إلَّا اللهُ، فَإِذَا قَالُوهَا عَصَمُوا مِنِّي دِمَاءَهُم وَأَمْوَالَهُمْ إلَّا بِحَقِّهَا وَحِسَابُهُمْ عَلَى الله ”

    ” I have been commanded to fight the people up until they bear witness that there is no deity worthy of worship except Allah alone. Whoever declares that, then their blood and their wealth are safeguarded from me, except that which [Allah] has a right upon, and their account is with Allah.” Al-Bukhaaree (#2946) and Muslim (#21).

    Shaykh ul-Islaam continues;

    “Just as Allah has venerated it [al-Jihaad], He similarly venerates the people [of Jihaad], in Surah as-Saff He The Most High says,

    ” O you who believe! Shall I direct you towards a trade which shall save you from a grave punishment – Believe in Allah and His Messenger and perform al-Jihaad in His Path with your wealth and with your persons, that is better for you if you but knew. [By way of that, Allah will] forgive your sins and enter you into Gardens under which rivers flow, and pleasant dwellings in the Eternal Gardens. That is the supreme success – and after that which you will love, help from Allah and a victory [which is] near, and glad tidings for the believers.” Surah as-Saff:10-13

    And the saying of Allah The most High,

    ” Do you think that giving drinks to the pilgrims and maintaining the Sacred Masjid [makes you] equal to those who believe in Allah and the Last Day and the perform al-Jihaad in the Path of Allah. They are not equal before Allah, and Allah does not guide a people who are oppressors. Those who have believed, and performed the migration, and perform al-Jihaad in the Path of Allah with their wealth and their persons have an exalted status before Allah, and they are the successful. Their Lord gives them the glad tidings of Mercy from him and His Pleasure, and gardens for them in which there are eternal delights. They shall dwell therein forever, and Allah has [prepared for them] tremendous rewards.” Surah at-Tawbah:19-21

    And the saying of Allah,

    ” Whoever from amongst you abandons his Deen [religion], then Allah will bring a people whom He loves and they love Him, [they will be] merciful to the believers, stern to the unbelievers, performing al-Jihaad in the Path of Allah, not fearing the blame of the blamers, and this is a virtue from Allah which He bestows upon whomsoever He desires, and Allah’s is All-Sufficient and All-Knowing.” Surah al-Maa’idah:54.

    And Allah The Most High says,

    ” That is because they do not suffer any thirst, nor fatigue, nor hunger in the Path of Allah, nor do they take a step to enrage the disbelievers, nor inflict [damages] upon the enemy, except that it is written for them as a righteous action. Indeed Allah does not waste the reward of the Muhsineen [righteous]. Neither do they spend any contribution small or large, nor do they cross a valley, except that it is written for them for Allah to reward them according to the best of their actions.” Surah at-Tawbah:120-121.

    What has been mentioned [in these verses] is what they have brought about by way of their actions, and from the glad tidings of their actions [in the afterlife], and the matters of Jihaad and it’s virtues [contained] in The Book and The Sunnah are too numerous to enumerate, and it is due to this that [al-Jihaad] is the most virtuous supererogatory action that people can perform. It is unanimously agreed by the Scholars [of Islaam] that it is more virtuous that performing Hajj and ‘Umrah [pilgrimages] or performing supererogatory prayers or supererogatory fasting, as has been proven in The Book and The Sunnah, to the extent that the Prophet sallallahu alayhi was salama said,

    “The head of the affair is al-Islaam, and it’s pillar is the Prayer, and it’s upper most part is al-Jihaad.” [1]

    And he said,

    ” Indeed, within the Gardens of Paradise there are 100 levels, the [distance between] one level and another is like the [distance between] the sky and the earth. Allah has prepared these levels [specifically] for those who perform al-Jihaad in His Path.” agreed upon by both Imaam al-Bukhaari and Imaam Muslim in their two saheeh collections.

    And The Prophet sallahu alayhi was salama also said,

    “One whose feet are covered in dust[by performing al-Jihaad] in the Path of Allah, Allah has prohibited the Hellfire from touching him.” Narrated by Imaam al-Bukhaari.

    And the Prophet sallallahu alayhi was salama said,

    ” Ribaat [standing on guard] for a day and a night in the Path of Allah is better than fasting and standing in prayer for one month. And if he dies [whilst on guard] then Allah will write for him his regular actions of ibaadah [that he would have done had he lived], and provide him with provision, and protect his from the trials [of the grave].” narrated by Imaam Muslim.

    In the Sunan,

    ” [Standing] a day in Ribaat in the Path of Allah is better than settling for a thousand days anywhere else.”

    And he sallallahu alayhi was salama said;

    ” There are two eyes which the Hellfire will never touch, the eye which wept out of Khashiyah[humility] before Allah, and the eye which spends the night guarding in the Path of Allah.” An authentic hadeeth as stated by Imaam at-Tirmithee.

    And also it is [authentically narrated] in the Musnad of Imaam Ahmad,

    “Standing on guard for a night in the Path of Allah is more virtuous than a thousand nights standing in prayer and fasting in the days”.

    And in the two saheeh collections,

    ” A man said, O Messenger of Allah, Inform me of something which is equal to al-Jihaad in the Path of Allah?, he replied, “You do not have the ability to do it.”. So the man said “Inform me of it?”, he said, “From the time the one who goes out to perform al-Jihaad, can you fast continuously without breaking the fast, and stand in prayer continuously without resting?”, he said, “No.”, so he said, “That is equivalent to al-Jihaad.”

    In the Sunan, he sallallahu alayhi was salama said,

    “Every ummah has it’s Siyaahah [travelling], and the Siyaahah of my ummah is al-Jihaad in the Path of Allah.”

    And this subject [of al-Jihaad] is extensive, [so much so that] no other actions [of ibaadah] are rewarded like it is, nor are they as virtuous like it is.”

    [1] A da’eef [weak] hadeeth collected by Imaam at-Tirmidhee and Imaam Ahmad, which is however correct in it’s meaning, even though the isnaad is weak.

    Shaykh ul-Islaam rahimahullah continued and said,

    “And the [superior status of al-Jihaad] is obvious considering the prevalent benefits of al-Jihaad to both the one who performs it and others, in both this worldly life and in the afterlife. It encompasses a combination of types of ibaadaat[ acts of worship], inward and outward, as it includes [true] love of Allah The Most High, ikhlaas [sincerity] to Allah, tawakkul [complete reliance] upon Allah and surrendering [completely] one’s life and wealth to Allah, patient perseverance, [worldly] abstinence and remembrance of Allah, and [many] other the types of [righteous] actions which others deeds do not encompass.

    By way of it, the individual and the Ummah will always be between one of two outcomes; either [divine] aid and [military] victory, or martyrdom and the Gardens of Paradise. Certainly, man must live and die, and in this way [of al-Jihaad], he will be in extreme bliss in both this worldly lifem and in the afterlife, and by abandoning it [al-Jihaad] the extreme bliss [in this worldly life and the afterlife] will leave, or be decreased.

    And from the people, are those who desire to perform extreme [severe] actions in their religious and worldly life, and [yet] these [actions] scarcely [achieve any] benefits. [Whereas] al-Jihaad is the more beneficial than all of their actions in both [worldly and religious benefits]. [Another] person may busy himself in it [al-Jihaad] desiring [an easy] death, as it is the easiest [least painful] of all [types of] deaths[1], and it is the most virtuous of deaths[2].

    [1] It is authentically reported in the Sunan collections that the Messenger of Allah sallallahu alayhi was salama said,

    “The Martyr does not feel anything from the pains of death, except [something] similar to what you you would feel from the sting [/bite] of an insect.”

    [2] From the virtues of the Martyr are;

    1. All his sins will be forgiven.

    2. The angels will provide shade for the martyr with their wings.

    3. Martyrdom guarantees Paradise.

    4. The martyr is inside green birds in Paradise until the day of Qiyaamah.

    5. They are not punished in their graves [except if they have a financial debt not paid back..!!!!]

    6. The Martyr is protected from the terror the blow of the Horn signifying Qiyaamah.

    7. He can intercede for seventy of his family members.

    9. He will feel tranqil instead of terror on the Day of Judgment.

    10. The angels continuously visit the martyrs and deliver their greetings to them.

    Shaykh ul-Islaam continues,

    ” Since the foundation of the legislated combat is al-Jihaad, and the objective of al-Jihaad is to make all of the religion [purely] for Allah[1], and to make the Kalimah of Allah [Tawheed] uppermost [2], then whoever prevents that should be fought by the unanimous agreement of the Muslims. As for those [disbelievers] who are not preventing, or fighting [against the Muslims] such as women, children, monks, the elderly, the blind, the infirm, and others [similar] to them, the majority of Scholars agree they are not to be fought, unless they fight us in their speech [such as propaganda or incitement against the Muslims] or in their actions [such as assisting those who fight or prevent the Muslims], [whereas] some of the Scholars hold the opinion they can all be fought except women and children, because they [become] the property of the Muslims [i.e. ghaneemah (war booty)].

    The first opinion [however], is the correct opinion, as the [legislated form of] fighting, is to fight those who fight us when whenever we intend to make the religion uppermost as Allah the Most High said,

    ” And fight in the Path of Allah, those who fight you and do not transgress, indeed Allah does not like the transgressors.” Surah al-Baqarah:190

    And in the Sunan [collections of hadeeth] it is [authentically] reported that, “The Prophet sallallahu alayhi was salaam came across a woman who had been killed in one of the battles, so he stopped and said to the people, “She is not one who is to be killed.”, so he told one of them to catch up with Khaalid ibn al-Waleed and tell him not to kill [women or] children nor [non combatant] servants.” [Musnad Ahmad 3/488], and it is reported in the Sunan that he said, “Do not kill the very elderly, small children or women” [3]

    So for this [reason], Allah the Most High has permitted the killing of people if it is necessary for the welfare of the creation just as Allah the Most High says,

    “And fitnah is worse than killing.” Surah al-Baqarah:191

    So in killing there is a harm and evil, but the harm and evil of the fitnah of the disbelievers [their obstructing the religion of Allah] is far worse. As for the one who does not obstruct the establishment of the religion of Allah, then his harm is only towards himself, just as the Scholars have said that the one who invites to innovation which opposes the Qur’aan and the Sunnah, his punishment is not like the one who is silent [and who does not invite to it], as comes in the [authentic] hadeeth, “a sin which is committed in private only harms it’s doer, whereas a sin which is committed openly, and it is not prevented, harm the community.”

    So for this reason the Sharee’ah obligates fighting the disbelievers, but not the killing of captives from amongst them. If a man is captured from them in fighting them, or not by fighting them, such as [being captured on] a [shipwrecked] boat or [from] losing his way, by a stratagem, then the Imaam [leader] may do whatever [he decides] is best, from killing him, or enslaving him, or freeing him, or ransoming him for property or people [in exchange for his freedom]. This is [the agreed opinion] with most of the Scholars as is proven in the Qur’aan and the Sunnah. Some of the Scholars are of the opinion that ransoming is abrogated.

    So then [in this way], the People of the Book [the Jews and the Christians] and the Majoos [Zoroastrians] are to be fought until they accept al-Islaam [as their new faith], or “..until they pay the Jizyah [tribute] by their hands, and they are belittled.” Surah Tawbah:29 [4]

    With regards to others [such as the pagans, Sabians, etc], the Scholars differed as to whether the Jizyah should be taken from them, but the generality of Scholars agreed that the Jizyah is not to be taken from the [pagan] Arabs.

    [1] Allah says,

    , ” وَقَـتِلُوهُمْ حَتَّى لاَ تَكُونَ فِتْنَةٌ وَيَكُونَ الدِّينُ للَّهِ “,

    “And fight them until there is no more Fitnah[shirk], and the Deen[religion] is for Allah alone.” Surah al-Baqarah:193

    [2] The Messenger sallallahu alayhi was salama said,

    , “«مَنْ قَاتَلَ لِتَكُونَ كَلِمَةُ اللهِ هِيَ الْعُلْيَا فَهُوَ فِي سَبِيلِ الله»

    “Whoever fights in order that the Kalimah of Allah becomes uppermost, then he is the one [who is truly] in the Path of Allah.” [agreed upon hadeeth]

    [3] So in summary those women and children who are not fighting or preventing are not to be killed as they become the property of the Muslims, whereas those women and children who fight and prevent are to be killed as combatants, and this is the majority opinion of the Scholars of Ahl us-Sunnati wa al-Jama’ah.

    [4] Imaam Ibni Katheer rahimahullah, said in his tafseer of this ayah,

    “Allah said,

    , ﴿حَتَّى يُعْطُواْ الْجِزْيَةَ﴾

    (until they pay the Jizyah), if they do not choose to embrace Islam,

    ﴿عَن يَدٍ﴾

    (with willing submission), in defeat and subservience,

    ﴿وَهُمْ صَـغِرُونَ﴾

    (and feel themselves subdued.), disgraced, humiliated and belittled. Therefore, Muslims are not allowed to honour the people of Dhimmah or elevate them above Muslims, for they are miserable, disgraced and humiliated. Imaam Muslim recorded from Abu Hurayrah radi Allahu ‘anhu that the Prophet sallallahu alayhi was salama said,

    «لَا تَبْدَءُوا الْيَهُودَ وَالنَّصَارَى بِالسَّلَامِ، وَإِذَا لَقِيتُمْ أَحَدَهُمْ فِي طَرِيقٍ فَاضْطَرُّوهُ إِلَى أَضْيَقِه»

    “Do not initiate the Salaams to the Jews and Christians, and if you meet any of them in a road, force them to its narrowest alley.”

    This is why Ameer ul Mu’mineen ‘Umar bin al-Khattaab, radi Allahu ‘anhu, demanded his well-known conditions [of the Jizyah protectional tribute] be met by the Christians, it was these conditions that ensured their continued humiliation, degradation and disgrace.

    The scholars of Hadeeth narrated from ‘Abdur-Rahman bin Ghanam Al-Ash’aree that he said, “I wrote down [the following] for ‘Umar bin Al-Khattab, radi Allahu ‘anhu, as the terms of the treaty of peace he conducted with the Christians of Ash-Sham:

    ‘In the Name of Allah, the Owner and Bestower of all Mercy.

    This is a document to the servant of Allah ‘Umar, the Leader of the faithful, from the Christians of such and such city. When you (Muslims) came to us we requested safety for ourselves, children, property and followers of our religion. We made a condition on ourselves that we will neither erect in our areas a monastery, church, or a sanctuary for a monk, nor restore any place of worship that needs restoration nor use any of them for the purpose of enmity against Muslims.

    We will not prevent any Muslim from resting in our churches whether they come by day or night, and we will open the doors of our houses of worship for the wayfarer and traveler. Those Muslims who come as guests, will enjoy boarding and food for three days. We will not allow a spy against Muslims into our churches and homes or hide deceit or betrayal against Muslims. We will not teach our children the Qur’aan, publicize practices of Shirk, invite anyone to Shirk or prevent any of our fellows from embracing Islam, if they choose to do so.

    We will respect Muslims, move from the places we sit in if they choose to sit in them. We will not imitate their clothing, caps, turbans, sandals, hairstyles, speech, nicknames and title names, or ride on saddles, hang swords on the shoulders, collect weapons of any kind or carry these weapons. We will not encrypt our stamps in Arabic, or sell alcoholic drinks.

    We will have the front [half] of our hair shaved, wear our customary clothes wherever we are, wear belts around our waist, refrain from erecting crosses on the outside of our churches and demonstrating them and our books in public in Muslim fairways and markets.

    We will not sound the bells in our churches, except discretely, or raise our voices while reciting our holy books inside our churches in the presence of Muslims, nor raise our voices with prayer at our funerals, or light torches in funeral processions in the fairways of Muslims, or their markets. We will not bury our dead next to Muslim dead, or buy servants who were captured by Muslims.

    We will be guides for Muslims and refrain from breaching their privacy in their homes.’ When I gave this document to ‘Umar, he added to it, ‘We will not beat any Muslim.

    These are the conditions that we set against ourselves and followers of our religion in return for safety and protection. If we break any of these promises that we set for your benefit against ourselves, then our Dhimmah (promise of protection) is broken and you are allowed to do with us what you are allowed of people of defiance and rebellion.”

    Imaam Ibni Katheer also mentioned that the Messenger sallallahu alayhi was salama took Jizyah from the Zoroastrians of Hajar. and from some of the border lands of Syria.

  2. Shaykh, Abu Muhammad Al-Maqdisi said: “And that is why I tell the enemies of Allah during their interrogations of me, and during their offers and threats which they sometimes give me, attempting to win me over to collaborate with them and work with them;

    [I tell them]: It would be more realistic, and easier, if you were to collaborate with me rather than me collaborating and working with you. For I consider you as enemies, and as Kuffaar.

    So is it logical to think that I would work at a post, whose people I label as Kuffaar? And is it logical that I would collaborate with my enemies?

    And even if I were to work with you, you could never pay me the payment which Allah has promised me if I fulfill my obligations towards Him, firm in patience and sincerity. And if you were to work with me, and you became Helpers of the Deen of Allah, then your payment, if you are sincere, is a Paradise, the width of which is the Heavens and the Earth. So what is your governments’ salaries and wages worth, in front of a Paradise the width of which is the Heavens and the Earth?

    And if you were to work with me, you would be committing treason according to your terminology against your country. But this is something trivial, and is weightless in comparison to treason against Allah and His Deen. And the penalty sentenced by the country upon your treason, is nothing in front of the Torment of Allah which I will go through if I were to betray His Deen by working for you. Likewise, if you lose your country’s salary and wage, this is nothing in comparison to losing a Paradise, the width of which is the Heavens and the Earth. And that is the evident loss. This is why you working with me is more realistic, and easier, than me working with you

  3. THE BOOK OF JIHAD

    CHAPTER 1: ON THE COMMAND OF JIHAD AGAINST THE NON BELIEVERS AND ITS MANDATE, AND THE STERN WARNING AGAINST THOSE WHO DON’T PRACTICE JIHAD:

    The Command To Fight:

    “Fighting has been enjoined upon you while it is hateful to you. But perhaps you hate a thing and it is good for you; and perhaps you love a thing and it is bad for you. And Allah knows, while you know not”14“

    And fight in the cause of Allah and know that Allah is Hearing and Knowing”15“

    And if it were not for Allah checking [some] people by means of others, the earth would have been corrupted, but Allah is full of bounty to the worlds”16“

    Then kill the polytheists wherever you find them and capture them and besiege them and sit in wait for them at every place of ambush”17“

    Fight those who do not believe in Allah or in the Last Day and who do not consider unlawful what Allah and His Messenger have made unlawful and who do not adopt the religion of truth [i.e., Islam] from those who were given the Scripture – [fight] until they give the jizyah18

    willingly while they are humbled”19

    Imam Al Haleemi in Suab al Iman:Allah clarified that if it weren’t for Allah checking the nonbelievers through the believers and giving the believers authority to protect Islam and break the armies of disbelief, disbelief would have reigned on earth and the true religion would have been eliminated. This proves that the reason for the survival of religion (i.e., Islam) is Jihad and whatever is in this status deserves to be a pillar of Iman.1.     Messenger of Allah () said: “I have been ordered to fight against the people until they testify that there is none worthy of worship except Allah and that Muhammad is the Messenger of Allah, establish the prayer and give the zakah. Then, if they do that, their blood and wealth will be protected from me – except in accordance with the right of Islam. And their reckoning will be with Allah, the Exalted”20

    It was narrated by Ibn Umar, Abu Huraira, Jabir Ibn Abdullah, Anas bin Malik, Jareer ibn Abdullah, Aus ibn Abu Aus, ibn Abbaas, Sahl ibn Saad, al-Numaan ibn Basheer, Tariq ibn Ashyam, Abu Bakrah, Muadh bin Jabal and Samura bin Jundub.Thus, the hadith is Mutawatir, the absolute strongest form of Hadith.Among a few interpretations Ibn Hajjar mentions the strongest is that people are fought to establish the dominance of Allah’s law. This objective can be met through many means. It could be met by fighting them. It can also be met by them accepting the law of Allah and paying the Jizyah. It can also be met by some sort of peace accord between Muslims and others, in which the non-Muslims will not oppose the word of Allah in any way.

    2. Abu Muthana Al Abdi said I heard Abu Al Khasasyah say “I came to the Messenger of Allah and said I would pledge allegiance to him. The Messenger of Allah took the pledge from me ‘to testify that there is none worthy of worship other than Allah that Muhammad is the Messenger of Allah, to pray the five prayers, to fast Ramadan, to pay Zakah, to make Hajj, and to fight in the sake of Allah.’ I said ‘O Messenger of Allah, Two of those I cannot do. The first is Zakah. I only have ten camels. They constitute my entire wealth. The second is Jihad; I heard that whoever runs away from the battlefield has incurred the wrath of Allah. I am afraid if fighting faces me I might fear death and my spirit would fail me.’ Rasulullah grabbed his hand and waved it and said, ‘No sadaqah and no Jihad! How can you then enter into Jannah?’”. Abu al Khasasyah then said: The Messenger of Allah took my pledge on every term he mentioned.” 21…

    3. Salamah bin Nufail said: While I was sitting with Rasulullah a man came to him and said, “O Messenger of Allah Horses are being discarded and weapons are been laid down and some are claiming that there is no more fighting” Rasulullah said, “They are lying! Fighting has just begun! And a party of my Ummah will fight for the sake of Allah, and those who oppose them will not harm them. Allah will deviate the hearts of some men to provide for that party from them by fighting them. And they will continue fighting until the final hour starts (the Day of Judgment) and good will remain on the foreheads of horses until the day of Judgment and war will not end until Yagog and Magog come out.”22

    A similar hadith was narrated by Imam al Nasa’i and is hasan (agreeable):

And a party of my Ummah will remain fighting on the true path and Allah will deviate the hearts of some men and Allah will provide the fighters from them until the final hour starts and the promise of Allah is fulfilled and good is on the foreheads of horses until the day of Judgment. It is being revealed to me that I will be departing you soon and you would follow me while you are fighting each other and the house of the believers is in al Shaam”23.

    In the commentary on Al Nasa’i by al Sindi, he states that:“‘Humiliating horses’ means ignoring them and belittling their importance or not using them for combat.‘Now fighting has started now fighting has started’ The repetition is to reveal the importance of the message and it means that fighting is only increasing and that Allah has just prescribed it so how can it end so soon? Or it means that the real fighting has just begun…

    because so far they have been fighting only within their territory, the land of the Arabs, but now is time for them to carry the battle to further lands.‘Allah will deviate the hearts of some’ It means Allah will always provide this party of believers with men to fight even if it means deviating their hearts from Iman to Kufur. That is to bless these believers by providing them with the honor of fighting in his sake and the ultimate pleasure of pleasing Allah.

    24‘Good is on the foreheads of horses,’ Means reward and booty, or honor and pride. ‘The house of the believers is al Shaam’ that is referring to the end of time. It will be the stronghold of Islam and the land of Jihad. ”25

    5. Anas narrates that the Messenger of Allah said: “Fight the nonbelievers with your wealth, arms, and tongues”

    26With your tongues means hurt the non-believers by letting them hear what displeases them.6. The Messenger of Allah said: “I have five commands for you: To Listen, to obey, to fight jihad, to make hijrah, and to stay with the jama’ah”27

    7. Ibn Abbaas narrates that the Messenger of Allah said, “There is no Hijrah after the opening of Makkah but there is Jihad and intentions and if you are called to fight then fight”28

    your lives in the cause of Allah. That is better for you, if you only knew”Comments on the meaning of “light and heavy” in this verse:Abi Saleh said: The young and old. Also Qatadah said: Active or inactive, energetic or not .It is narrated that Abu Ayub al Ansari took a rest from Jihad for a year. He then recited this ayah and said, “I do not find for myself an excuse in this ayah” so he resumed his Jihad.Abu Shaybah narrated with an authentic narration to al Hakam: Busy or preoccupied.It is also said the “heavy” is the one who has property which he fears would be lost if he joins Jihad. While the “light” is the one with no property to worry about.Al Qurtubi says, “the ayah is general and applies to everyone whether joining is easy for them or not”Al Zuhri states that Ibn Al Musayab joined the army when he had already lost one of his eyes due to old age. He was told you are ill, he said, “Astaqfirullah (May Allah forgive me) Allah says the light and the heavy. If I am incapable of fighting at least I will increase the number of the army and would guard your luggage” 29

    8. Abu Ya’la and al Hakim narrate with an authentic chain: Anas bin Malik said that Abu Talhah recited al Tawbah and passed by this verse “Go forth light or heavy” and said I see that Allah is calling upon me whether I am young or old. So he told his sons to prepare him for combat. They said you have already fought with Rasulullah until he died and then with Abu Bakr until he died and then with Umar. So now let us fight on your behalf. He said, “Prepare me for combat” and they did. He went on an expedition in the sea and died. They didn’t find an island to burry him until seven days latter and his body never changed.

    9. AbdulRazaq narrates that Makhool used to face Qiblah and then…

    swear ten times in the name of Allah that going out in expeditions is mandatory on you. He would then face his students and say, “If you want be to swear beyond ten times I would do so”

    Is Jihad Fard Kifayah Or Fard Ayn?

    Realize that attacking the non-believers in their territories is a collective duty (fardh kifayah) with the consensus (ijmaa) of the scholars. However ibn al Musayeb and ibn Shubrumah state that it is a duty (fardh ayn) on each and every individual

    .“The minimum participation in Jihad is once a year, and more is always better. It is not allowed to have a year pass you by without any fighting except out of necessity like the weakness of Muslims and the great numbers of the enemy, or fear of extermination if you attack them first, or lack of provisions, or similar excuses. Otherwise, if there is no necessity it is not allowed to delay attacking the non-believers for more than a year.” Imam Shafi’i states that.

    The imam of al Haramain says: “I adopt the opinion of the scholars of usool. They stated that Jihad is a mandatory call and must be established according to the ability until none remains in the world but a Muslim or one who has submitted to Muslims. Thus, Jihad is not limited to once a year. It should be done more frequently if possible. What the scholars of fiqh stated is because usually the time spent in preparations for combat limit the ability to wage war to once a year.

    ”The author of al Mugni from the Hanbali school states: “The minimum jihad is once a year, so it is mandatory every year. If there is a need to fight more than once a year, it becomes mandatory on the Muslims to fulfill that need.

    ”Al Qurtubi states in his tafseer: “It is mandatory on the Imam to send an army of Muslims to the land of the enemy once every year and the Imam should participate himself in such expeditions. If not, then he should send someone capable whom he trusts, to call them to Islam, keep away their harm, to give victory to the religion of Allah, until they enter Islam or pay jizyah” 30

    Muslims will never taste peace in their lives if they do not.

    Jihad is not mandatory on children, the mentally incapable, women, and the ill. It is mandatory however, on the one-eyed, the one who is suffering from a mild illness such as a headache, a sore tooth, or fever, or the one who has a slight limp. This is in the madhab of Imam Ahmad, and I don’t know any disagreement regarding that and Allah knows best.

    It is the consensus of scholars that one cannot participate in Qazw31 without the permission of the parents.

    This is all regarding the Jihad, which is a collective duty (starting the non believers with war and on their territory). But if the enemy enters the Muslim land, or even approaches it and masses on its borders, even if they do not actually enter it, and there armies are double the size of that of the Muslims or less, then Jihad becomes mandatory on each and every individual. Then, the slave leaves without the permission of the master, the woman without the permission of her husband (if she has the strength to fight according to the stronger opinion), the son without the permission of the parents, and the one indebt without the permission of the lender. All of the above stated is the opinion of Imam Malik, Ahmad, and Abu Hanifah32.

    If the enemy ambushes the Muslims in a certain area and they don’t have a chance to assemble together and prepare to fight, then whoever is faced by a nonbeliever, or a group of nonbelievers, and the Muslim knows that if he surrenders he would be killed, then he must fight. There is no difference in this ruling between a freeman, slave, man, woman, blind, limp, or ill. If there is only the possibility of being killed if surrendered, but would defiantly be killed if he refuses to surrender, then it is allowed to either surrender or fight, but fighting is better.

    If a woman thinks if she is taken prisoner she would be sexually abused, it is mandatory on her to fight, even if that would lead to her death because if a person is forced to commit adultery or fornication it is not allowed to give in even if to save one’s life.

    Now if some of the Muslims in the attacked area go to fight the enemy and they are sufficient in numbers and are capable of fighting the enemy alone,attack the enemies of Allah and on their turf. The consequences of not fulfilling that duty is the price we are paying today. If you don’t keep shaytaan in check he will not leave you alone.]

    it is still a duty on the rest to help. Al Mawardi states that because it is a Jihad of defense so it remains a duty on every Muslim capable of fighting in that territory.

    If the nonbelievers descend on an unpopulated Muslim land that is far away from populated areas there are two opinions in that, and Al Gazali narrates both;

    The first is that of the Imam al Haramain. He states that it does not become mandatory on Muslims to fight and put their lives in danger to protect such a secluded, unpopulated land.

    The other opinion, which is the position of the madhab, is that it is mandatory for Muslims to fight for that land.

    Imam Nawawi says the opinion of the Imam (of al Haramain, al Juwaini) is unacceptable. How can we -the Muslims-allow the non-Muslims to take away part of the Dar al Islam with our ability to protect it?

    Al Qurtubi says: If the enemy just comes close to Muslim territory, even without entering it, it becomes mandatory on Muslims to go and meet the enemy in order for the religion of Islam to prevail and gain the upper hand and to humiliate the enemy.

    Al Baghawi states that it is mandatory on the Muslims who are closest to the invaded land, and is a collective duty on the Muslims who are far away.

    The Punishment Of Those Who Don’t Participate In Jihad:

    Allah says:Say [O Muhammad], “If your fathers, your sons, your brothers, your wives, your relatives, wealth which you have obtained, commerce wherein you fear decline, and dwellings with which you are pleased, are more beloved to you than Allah and His Messenger and jihad in His cause then wait until Allah executes His command. And Allah does not guide the defiantly disobedient people”33

    In this ayah is a sufficient warning for anyone who leaves jihad with their selves and their wealth Allah says:…

    “O you who have believed, what is [the matter] with you that, when you are told to go forth in the cause of Allah, you adhere heavily to the earth? Are you satisfied with the life of this world rather than the Hereafter? But what is the enjoyment of worldly life compared to the Hereafter except a [very] little.

    If you do not go forth, He will punish you with a painful punishment and will replace you with another people, and you will not harm Him at all. And Allah is over all things competent”34“

    Those who remained behind rejoiced at their staying [at home] after [the departure of] the Messenger of Allah and disliked to strive with their wealth and their lives in the cause of Allah and said, “Do not go forth in the heat.” Say, “The fire of Hell is more intense in heat”-if they would but understandSo let them laugh a little and [then] weep much as recompense for what they used to earn.”35

    10. Ibn Umar narrates: I heard the Messenger of Allah saying, “If you trade in each, and follow the tails of cows, and became content with being farmers, and ignored jihad, Allah will impose on you a humiliation that would not be taken away until you go back to your religion.”36

    The meaning of the hadith is that if people ignore jihad because of their involvement in agriculture and similar affairs, Allah will unleash upon them their enemies which would bring them humiliation which cannot be eliminated unless they go back to what is a duty upon them to start with and that is jihad against the non-believers, and being harsh and rough on them, and establishing religion to give Islam and its followers victory and to raise the word of Allah high and to humiliate disbelief and its followers. This hadith shows that leaving jihad is leaving Islam because the Messenger of Allah said: “until you go back to your religion”

    stood on the pulpit and among what he said was, “ If people do not practice jihad Allah will inflict them with poverty”

    One might say that ‘I see some people not practicing jihad nevertheless they are wealthy’. The answer is that wealth is not the amount of money you have, but wealth is a feeling of contentment and satisfaction that exists in the heart. When people stop practicing jihad they miss out on the booty of war. When they do that and instead turn their attention and effort to making wealth from various other means, they get involved in a lot of prohibited methods of making money.You then rarely find anyone among them whose wealth is all pure halal. They became greedy over miser things of this world. That made them humiliated and they became slaves to money.

    But the mujahid is free of greed and is depending on Allah for his provisions. Allah provides for him from the booty. He wins it by his sword and it is pure halal.

    13. Abu Hurairah narrates that the Messenger of Allah said: “Whoever dies and has not fought or had the intention of fighting dies on a branch of hypocrisy”37

    14. Abu Umamah narrates that the Messenger of Allah said: “Whoever has not fought or prepared a fighter or taken care of a fighter in his absence, Allah will strike him with a disaster” Abu Dawud (Agreeable)

    An Advice To The Ones Who Stay Behind38

    Know! Oh abstainer from that which has been obligated of jihaad!Deviator from the ways of success and correctness, that you have been exposed to expulsion and relegation. By Allah! Prevented from happiness by obtaining the objective. addWhat that I knew! The reason for your abstinence from fighting and plunging yourself into the battles of the brave. Your miserliness in the path of Allah with your soul and wealth. All this is due to distant hopes, fear of…

    an on-slaughting life span and hatred of leaving a beloved from family, wealth, son, servant, or relative. A blood brother of yours, a compassionate relative, a generous supporter, a cherished friend, working extra pious deeds, love of a beautiful wife, a preventative high rank, a lofty position, a raised palace, a long shade, magnificent garments or wholesome food. There is not beside these that hinder you from jihaad and none beside these distant you from the Lord of the worshipers.

    By Allah! What is this from you? Oh brother! Did you not hear the words of the Most High?

    “Oh you who believe what is the matter with you that when you are asked to march forward in the cause of Allah you cling heavily to the earth are you pleased with the life of this world rather than the hereafter but little is the enjoyment of the life of this world as compared with the hereafter”39

    Hearken! To that which I dictate to you of decisive evidences and listen that which I present to you of glaring proofs, so that you may learn, nothing hinders from jihaad, not even the two Holy Mosques40

    and there is no reason for your delay except the lower self and the devil.•

    “But I fear death!”As for your appease to distant hopes, fear of an on-slaughting life span, vigilance of death which must occur and fear of the path which must be traversed, by Allah! Verily! Bravery does not shorten the life of the brave just as refrainment does not lengthen the life of those who lag behind:

    “And every nation has its appointed term when there term is reached neither an hour can they delay nor an hour can they advance.”41“

    And Allah grants respite to none when his appointed time comes and Allah is all aware of what you do.”42…..

    # A call to migrate to Allah by clearing Tawheed (Monotheism), disavowal from shirk and association, and a migration towards the Prophet, peace and blessings be upon him, and following him clearly.

    # A call to manifest Tawheed (Monotheism) and proclaim the most powerful knot of Eman (Faith), to uncover the way of the two friends (of Allah) Muhammad and Ibrahim peace be upon them, and to demonstrate the alliance to Tawheed (Monotheism) and its people and enmity towards shirk and its people.

    # A call to implement the Tawheed (Monotheism) by striving against all the Tawaghit, by the word and the sword, and to direct humans from worshipping the creation to worshipping the Lord of the creation, and from the oppression of the manmade laws and religions to the justice and light of Islam.

    # A call to seek Islamic knowledge from its pure sources, and to break the idolatry of the government scholars and to reject blind following the monks and priests who corrupted the religion and deceived the Muslims.

    And was the religion corrupted except by kings and the evil scholars and monks

    # A call to an insight about current events, and to identify the path of all the wrongdoers regardless of their different ways and beliefs ” Say (O Muhammad): “This is my way; I invite unto Allah (i.e. to the Oneness of Allah – Islamic Monotheism) with sure knowledge, I and whosoever follows me (also must invite others to Allah i.e to the Oneness of Allah – Islamic Monotheism) with sure knowledge. And Glorified and Exalted be Allah (above all that they associate as partners with Him). And I am not of the Mushrikun (polytheists, pagans, idolaters and disbelievers in the Oneness of Allah; those who worship others along with Allah or set up rivals or partners to Allah).”

    # A call to serious preparations on every level to fight in the cause of Allah, and striving towards fighting the Tawagheet and their helpers, the Jews and their allies to free the Muslims and their lands from their imprisonment and occupation.

    # A call to catch up and follow the manifest saved sect, who are establishing the Deen (Religion) of Allah who are not harmed by those who oppose them or those who abandon them until the command of Allah comes.

  5. An Analysis of Shaykh Al-Albani’s views on Jihaad

    None is worthy of worship save Allaah and Muhammad, sallallahu ‘alayhi wa sallam, is His Messenger and Apostle!

    In response to Tabib Al-Ahmed Al-Bengali and his tag-team Saudi Salafi Co. who label me Khaawarij (by definition, they are those who help Kuffurs and Apostates against Muslims) and in response to Hizb-ut-Tahrir and Tanzeem Islam, both in particular exposing their weak methodology on re-establishing Khilaafah/Caliphate, Akhee Samir Khan aka In Sha’ Allaah Shaheed Blogger has come up with an analysis of Shaykh Al-Albani’s views on Jihaad Bi’Iznillaah, and Jazakum Allaahu Khayran to Akhee Samir Khan whose site helped me in every walks of my research and the following is purely his Allaah-gifted hand-works. Now let’s commence:

    We will be taking a look at some of the views of Shaykh Al-Albani regarding Jihaad. There are quite a few works to look at, so we chose to use a summarized book regarding his beliefs on this subject. The book itself is a general guideline to the Salafi ‘Aqeedah entitled, “Mujmal Masaa’il al-Eemaan al-‘Ilmiyyah fee Usool al-‘Aqeedah as-Salafiyyah” which means General Issues of Faith from the Fundamentals of the Salafi Creed written by the Shuyookh Husayn al-‘Awaayshah, Muhammad Moosaa Aal Nasr, Saleem ‘Eed al-Hilaalee, ‘Alee Hasan al-Halabee and Mash-hoor Hasan; the translation and commentary is done by Shaykh Bilal Philips and in his commentary, he makes references to Shaykh Al-Albani’s words regarding the guidelines of the Salafi ‘Aqeedah. We will be focusing on the chapter on Jihaad.

    Since Shaykh Al-Albani is not with us today, this brief critique is geared towards Shaykh Bilal Philips and the followers/students of Al-Albani and we hope that they are able to read this and respond.

    Shaykh Al-Albani said,

    “Jihaad in this time, in fact, from before this time, is an individual obligation because the current problem is not just the problem of Bosnia which has newly stirred the emotions of Muslim youths. For we have in our neighborhood the Jewish occupation of Palestine and none of the Islamic states have taken any action towards fulfilling the obligation of making Jihaad against them and expelling them; or ‘throwing them into the sea’ as one of the leaders of the Arab states stated. What I mean is that Jihaad is an individual obligation because many Muslim lands were occupied in the past and remain occupied in the present [like Kashmir, Sinkiang in China, Southern Russian states, Mindanao in Southern Philippines, etc.] by some of the disbelievers and this type of occupation is not hidden from any Muslim who is concerned about the affairs of Muslims, not to mention Islamic organizations, parties or Islamic countries.” (Tape: Silsilah al-Hudaa wan-Noor, 720/1)

    This, of course, is the correct opinion.

    Shaykh Bilal Philips mentioned that there are some other footnotes to look at so as to not take this above quote of his out of context.

    So here are those remaining footnotes:

    Shaykh Al-Albani said:

    “There must be a leader for Muslims to whom an oath of allegiance is given and not chaotic individual initiative.” He also stated: “For fard kifaa’ee Jihaad it is okay for a small group to gather and perform Jihaad. But for fard ‘aynee Jihaad we need the whole nation of Muslims. How can we have the whole nation of Muslims if we don’t have a unified leadership for this kind for Jihaad? I do not see any of the Mujaahideen calling for this kind of ameer…”

    Here, we agree and disagree. We agree where he mentions that unified leadership is important. If we want the Jihaad to take its roots and change world events for the better, then we need leadership. And by Allah’s Grace, He has granted the Ummah this leadership with the Islamic Emirates in ‘Iraq, Afghanistan, and Sheeshaan. However, to be more specific, the leadership seems to be more rooted in with Tandheem al-Qaa’idah as they have sent its soldiers across the world to train their fellow believers in the fields of military and Deen, and they fight alongside them, and they educate the Ummah in general with their releases. As for the overall level of leadership, it lies with the Islamic Emirates and their leaders who are Mullah ‘Umar, Abu ‘Umar al-Baghdadi, and Dokka Umarov. Depending on where the believer will fight, he will be under that leadership. And it is understood amongst the Mujaahideen around the world that Afghanistan is the launching pad for the training and sending out of forces.

    Shaykh Al-Albani passed away in 1999, and it was only two years later that this unified leadership started to take its place. So it is true that he didn’t live to see the fruits of the current day battles. However, Afghanistan – which was controlled by the Taliban – was a living phenomenon during his late years. So if there wasn’t, there should have been an effort by him and the ‘Ulema to train the Taliban in issues where they felt training was necessary. But as was apparent, not that many were interested nor excited in the Islamic establishment of Afghanistan, wa la howla wala quwatta illa billah.

    The Shaykh continues,

    “Jihaad must be under the supervision of a single Imaam or Khaleefah. But, let me tell you about some thing that troubles many of the students of knowledge, that there are many groups that fight like the Afghans or those [Ikhwaan] in Syria a decade or more ago. If they want to fight, they must be under the leadership of one Ameer.That doesn’t mean that Syrians fight in Afghanistan and Afghans fight in Syria, no. It means that both fighting groups must be under the supervision of one Imaam and one khaleefah.

    And today, this is the case, walhamdullillaah, as we mentioned earlier. So those who claim to be upon the Salafi ‘Aqeedah must recognize this and throw their 1990s views in the garbage bin of history because the leadership has arisen and it is strong and active, terrifying its enemies day and night, bringing serenity into the hearts of those that believe, and establishing the Shari’ah on the earth of Allah.

    He continues,

    “If there isn’t a single Imaam and a single Jamaa‘ah (i.e. one unified group under a unified leadership, but with fighters fighting in different parts of the Islaamic world), both groups would be operating on their own. To do this type of fard ‘aynee Jihaad, it is obligatory on Muslims to be unified, and [this type of] unification needs a khaleefah. To establish this situation, we must start with purification and education (Tasfiyah wa Tarbiyah). We can not start with Jihaad right now.” (Tape: Munaazarah ma ‘a Tanzeen al-Jihaad al-Islaamee)

    Here are a few points to consider:

    1. Today, as we have mentioned, we have the three Emirates and then we have various groups around the world such as Shabaab al-Mujaahideen, Abu Sayyaf, and so on. But as we said earlier, the majority of these groups are influenced by Tandheem al-Qaa’idah and its leadership (i.e., Shaykh Usaamah, Dr. Ayman al-Zawahiri, etc.) in one way or another, and they respect its leadership. And the various groups do not make Baraa’ah (disavowal) to the Tandheem but rather, they recognize that they are all in the same boat because all of the fighters are fighting for the same cause. So although the soldiers of al-Qaa’idah are not as vibrant in the Philippines as they are in Afghanistan, we still see the leadership of the Tandheem in full support of the actions of the Mujaahideen around the world and they give both general and specific advice to the groups.

    2. This effort which the Tandheem is making is a sign of sincerity in trying to unify the groups under a single leadership and ready them for the Khaleefah, whenever it is announced. The quote of Al-Albani gives the impression that the Defensive Jihaad – which is fard ‘ayn – is on such a high level on the scales of obligations that it requires a Khaleefah. Although we agree that it is obligatory on the Muslims in general to have the Khaleefah – and part of this blame falls heavily on the ‘Ulema and the Governments of the Muslim lands – it should never be made a pre-requisite for the Jihaad as it was never made a pre-requisite before; and how can it be expected from the Muslim Ummah to not defend its lands from her enemies when they approach the lands, conquer it in the name of Shirk, spread their fasaad and culture of fawaahish? How can the Khaleefah be a pre-requisite in the heat of the bullets and bombs? Should the Muslims drop their weapons and wait for a Khaleefah to magically drop from the heavens? Or should the Muslims drop their weapons and wait for the 50 plus Muslim lands to elect a single Khaleefah, even though their hatred towards many of the symbols of Islaam is apparent from their tongues and actions? Or should the Mujaahideen come together and unify themselves (and this is a constant effort), fight the disbelievers, establish the Shari’ah, and work for the re-establishment of the Khaleefah?

    This opinion of Al-Albani is not practical nor logical nor based in the Shari’ah (as he brings no evidences). In addition, this opinion (and it is merely an opinion) is extremely dangerous for the Ummah as it allows the disbelievers to do what they please in the lands of the Muslimeen.

    Furthermore, the evidences are more grounded on the side of those who call for the Jihaad today, incite the believers, and wage it against the Kuffaar. The Fatwa of Shaykh ‘Abdullah Yusuf ‘Azzam, Rahimahullah, entitled “In Defense of Muslim Lands,” which by the way, many of the ‘Ulema of Saudi including Bin Baaz accepted,, states:

    Can we fight jihad while we haven’t an Amir? Yes! We fight, and we haven’t an Amir. None has said that the absence of a community of Muslims under an Amir cancels the Fard of Jihad. In fact we have seen Muslims at the time of the Crusades and during the Tartar invasions fighting with different Amir’s. In Halab (in Syria) there was an Amir, in Damascus there was an Amir, and in Egypt there was more than one Amir. Some of these even asked help from Christians against their brother Amir, as what happened when Shawar asked help from Christians against another Amir, Dar Gham, in Egypt. Not one of the scholars has said that such a situation and such corruption cancels the obligation of jihad for the DEFENSE of the Muslim lands. On the contrary it multiplies their duty. The same thing happened in Andalusia, as the poets said:

    “They were divided into sects, each in their places, Each place an Amir and its pulpit.”

    And another wrote:

    “That which made me despair of Andalusia, were the King’s titles,

    Great titles of which they were not worthy,

    Like the cat who mimics the lion by puffing himself up.”

    Not one of the scholars has said that “there is no jihad under these conditions;” in fact, the scholars were themselves in the front lines of Andalusia.The battle may be void of a legitimate commander appointed by the Amir. As it was on the Day of Mu’tah. Khalid Bin Walid stood up and raised the flag, that by him, Allah saved the Muslim army. And, for this he was commended by the Prophet (sallallahu ‘alayhi wassallam).

    Maybe the Imam or the Amir al Mu’mineen is not present, but this does not annul the obligation of fighting and the defense of the Muslim lands. We do not wait for the Caliphate to be restored. Because, the Caliphate does not return through abstract theories, amassed knowledge and studying. Rather, jihad is the right way to reform the divided authorities to the ultimate authority of the Caliphate.

    The Mujaahideen choose their Amir for jihad from amongst themselves. He organizes them and unifies their efforts and makes the strong support the weak. In a Sahih hadith from ‘Uqbah Bin ‘Aamar, who was amongst the to-be-mentioned party, said: “The Prophet (sallallahu ‘alayhi wassallam) sent out a party and he chose from amongst us a swordsman (leader). When we returned I said: I have not seen the like of when the Prophet (sallallahu ‘alayhi wassallam) blamed us. The Prophet (sallallahu ‘alayhi wassallam) said: Are you unable that if I appoint a man and he fails to apply my order to replace him with one who applies my order?” [Abu Dawood, Ahmad; Sahih]

    The Messenger of Allah (sallallahu ‘alayhi wassallam) encouraged them to change the Amir of the party even if he was given the flag by the noble hand of the Prophet himself. So how is it if there is no Amir from the beginning? Of the most critical situations requiring an Amir is that of war.

    Ibn Qadama said in AI Mughni 8/253: “The absence of an Imam does not postpone the jihad because much is lost in its postponement”.

    If the people choose an Amir, he must be obeyed as mentioned in Fath al-‘Ali al-Maalik 1/389. The Sheikh Miyara stated that if there is an absence of an Amir, and the people are agreed to appoint a great one in this time, to pave their ways, to make the strong support the weak, and he exerts his effort to achieve this to the best of his ability, it is evident that to stand against him is not permitted. Who opposes him seeking to create sedition, disobeys Islam and disrupts the Jama’ah. In Sahih Muslim is the hadith: “Different evils will make their appearance in the near future. Anyone who tries to disrupt the affairs of this Ummah while they are united, you should strike him with the sword, whoever he is.”

    So this opinion of Al-Albani is quite weak and is very dangerous when considering the results of following such an opinion. Had the Mujaahideen of today sat at home like the rest of us to watch the disbelievers enter our lands freely, the Ummah would be in a lot worse situation than now, without a doubt. But because of their love for Allah, His Messenger and Jihaad for Allah’s Cause, they rose from their beds, they rose when everyone was satisfied with sleep, and they put their trust in Allah, gave their resources for His sake, flocked in large numbers to the lands where they can humiliate the disbelieving armies with iron, force them to leave and hope for the Islamic establishment as well as martyrdom. So consider, and ponder over this; indirectly, this opinion of Al-Albani is one of the seeds of success for the disbelieving armies in the lands of the Muslims; had the Shuyookh passed out fataawa to have the Muslims unify themselves in the various lands and to wage Jihaad, our situation would be very different.

    3. The process of Tasfiyah (purification) and Tarbiyah (education) is an on-going struggle for every individual believer; so to suggest that the Jihaad cannot be done until we collectively reach a certain level of Imaan – which is only something that Allah can see – is also a very weak opinion.The process of Tasfiyah and Tarbiyah starts when the Muslim is born and ends when he dies; so nobody is suggesting that with the Jihaad, they leave these things. Nay, this is contrary to what the Mujaahideen of today say and do. The Mujaahid Shaykh, Abu Yahya al-Libi discussed this in detail in his tape, “Balancing between Jihaad and Seeking Knowledge.” To summarize, Tasfiyah and Tarbiyah is a must before going to the battlefield, during the battle, and after; and seeking knowledge does not have to be in the Universities; rather, it can be done on the battlefields. And if more of the notable Scholars of today made the effort to go to the lands of Jihaad to support the Mujaahideen for Allah’s sake, then this would become clearer. The love for Jihaad should never have a ban; rather, with this love, the individual becomes closer to Allah and His Messenger and hence their levels of Tasfiyah and Tarbiyah become much greater and much more intense than those students of knowledge who study in the most famous Islamic Universities such as those in Damascus, Saudi and elsewhere. Individuals can test individuals on issues related to ‘Aqeedah and test the strength of their Imaan, but to pass a general statement that we cannot go forth now because of this weakness is a weakness by itself since it is stopping the Muslims from fulfilling not only a fard but also an act of ‘Ibaadah.

    Shaykh Al-Albani continues,

    “The Jihaad which is obligatory, and an individual obligation, is not possible for individuals to fulfil. Not even by some Islaamic organizations or Islamic parties, because this type of Jihaad, especially in our time in which the means of fighting have multiplied, [cannot be fulfilled by them]. These parties or organizations, not to mention individuals, cannot fulfil this individual obligation.”

    Because of this statement, the followers of Al-Albani take these words to discredit every single effort in the world that is related to the Jihaad and the raising of the word of Allah. This is a statement based on nothing except empty rhetoric. Since Al-Albani was alive during the time of the Taliban, it is our right to ask his followers and students: how do you think the Taliban took over the majority of Afghanistan? Did they not start off as a small group of Islamic students, poorly equipped? Did they fight their way through the corruption upon the land of Afghanistan until they took hold of the majority? Or did they tell the people who were complaining of the highway robbers and drug dealers, “This is not the time for Jihaad. We cannot help you; our Imaan is not strong enough, we do not have the resources etc.?!” How silly is this statement?

    Then consider how silly this statement is: “This is not the time for Jihaad, even though it is fard ‘ayn.”

    This is what Shaykh Al-Albani is saying essentially.

    Shaykh Al-Albani continues,

    “Instead it is an obligation on the Islaamic countries that possess the weapons and forces and modern military means. Though, if they gathered and sincerely addressed this Jihaad they could fulfil this individual obligation. However, unfortunately, these countries have made no effort to fulfil the obligation of this Jihaad and, instead, they have left the responsibility to some organizations and parties which are unable to do anything to stop the incursions of the occupying disbelieving forces in some Islaamic countries. The reality bears witness that any Muslim group which tries to fight the aggressor, as in Afghanistan, or revolt against the ruler whose disbelief has become apparent, as happened in Algeria, for example, this sad reality proves that individual or party Jihaad cannot produce the fruit which is hoped for; that of making Allaah’s word supreme.

    Therefore, we believe that Jihaad cannot exist except under an Islaamic banner, first and foremost, and under a united Muslim army taken from different Islaamic countries and not from a single country or region. In addition to that, there must be taqwaa (fear of) Allaah, Most Great and Glorious, in avoiding the things, well known to Muslims, which Allaah, Most High, has prohibited, but which are far from being applied practically. I have said on more than one occasion … that the cause of the humiliation and degradation which has befallen Muslims today – absolutely unknown in previous Muslim history – is because they have failed to apply the Qur’aanic verse: “If you support [the religion of] Allaah, He will support you.” [Soorah Muhammad, (74): 7]” (Tape: Silsilah al-Hudaa wan-Noor, 720/1)

    As we pointed out earlier, the Taliban is an excellent example of a group that rose out of concern for the Ummah, waged Jihaad, and established the Shari’ah throughout Afghanistan. I fail to see why Shaykh Al-Albani doesn’t consider their immense success; it is almost as if he is overlooking it because they were the only group in this Century that successfully took over an entire Country through Jihaad and established Shari’ah and made it a land of Imaan and Yaqeen with Allah’s help.

    [This is to update you that Taliban have conquered many lands in Pakistan and have established Shari’ah after the ceasefire of the Pakistani Government. This shows the inability of Pakistani Taaghoot Government to resist the Army of Islam. The most popular field is the land of Swat where many embraced Talibans and supported them, and this is arguably something that the industrious political movement such as Hizb-ut-Tahrir couldn’t establish for the past 50 years of their effort and hard-works even though their figures simply rose to millions. And as for the subject of re-establishing Khilafah, like I said, should the Mujaahideen come together and unify themselves (and this is a constant effort), fight the disbelievers, and removing them from our lands, establish the Shari’ah, the work for the re-establishment of the Khaleefah is undeniably possible and is inevitably going to happen soon. One should note that this is not 2001 CE but 2009 CE or 1430 AH. The ‘super-power’ enemies of Islaam are in deep anguish and are defeated psychologically, politically, economically and militarily. And the re-establishment of Khilafah and Khaleefah will be followed and witnessed by their shameful defeat In Sha’ Allaah.]

    Also, there is no point in trying to rely on these governments of disbelief who don’t even establish the Shari’ah in their own lands. If we relied on them, then how can we expect to see a fruitful Jihaad where the land is ruled by Shari’ah?

    He continues,

    “Where is the preparation? And who is able to make the preparation? Individuals? No! Governments? Yes! Governments can make some preparation.”

    This statement, as is apparent, is empty of knowledge,/b> in regards to the preparation of the Mujaahideen around the world, especially in Afghanistan.

    He continues,

    “But they take their preparation from their enemies. So if Jihaad and fighting began between Muslims and disbelievers, Muslims would not be able to supply their forces with the necessary weapons and ammunition except by purchasing it from their enemies! That is something impossible. Therefore, the preparation commanded in this verse has not been done, even by Muslim countries, because they purchase their weapons of destruction from their enemies and opponents. And their enemies [who produce the weapons] are likely to include in the weapons [sold to Muslims] elements which will render the weapons useless when used against the disbelieving armies… When Allaah, Most Great and Glorious said: “Prepare for them whatever power and cavalry you are able, to make the enemy of Allaah and your enemy fearful…” this address, as is not hidden from every Muslim, was directed to the Companions of the Prophet (p), and then it was directed to the generality of Muslims based on the general wording of the text. However, this address was directed to the Companions after they were raised correctly, until they had become able to fulfill the instruction; preparation of the material force after making the necessary spiritual preparation with their souls or in their souls due to the education which the Prophet (p) provided them. And history repeats itself. Thus, one of the Muslim nations must be raised spiritually in order to make the material preparation. Today, we cannot find any people or nation who have fulfilled this obligation, about which we speak using two words: Tasfiyyah (purification) and Tarbiyyah (education)…” (Tape: Silsilah al-Hudaa wan-Noor, 720/1)

    Apparently, CBS News is throwing a fit about how the equipment of the US Army is being sold in stores in Pakistan via the Jihad of the Taliban. Masha’Allah, what a slap in the face! A piece of advice: as long as US soldiers are there, you can continue to expect more equipment to fall into the hands of the Mujahideen.

    And these words of his are old; today, this is no longer the case as the Mujaahideen are those who are prepared both in the Deen and the fields of military, and many of them make their own weapons; in addition, they get a lot of resources from the Ghaneema in the Jihaad and this is how they are able to support themselves, as at-Taa’ifah al-Mansoorah would support themselves.
